UWACAM Free Dive Professional Access Program

Program Overview

The UWACAM Free Dive Professional Access Program offers dive professionals one year of free and unrestricted use of the UWACAM camera app, including premium features such as:

UWACOLOR – Advanced underwater color correction
Vizalyzer AI Fish ID – AI-powered fish identification
Pro Mode Controls – Full manual settings for expert underwater videography and photography

Duties of Participants

As part of the program, participants agree to:

Promote UWACAM during regular diving activities by:
- Talking about the app with scuba diving clients
- Showing interested divers how the UWACAM camera app works
Publish at least one piece of content every two months (6 distributed over the year) on their preferred social media platform (Instagram, YouTube, TikTok, etc.), featuring:
- UWACAM in use
- Results achieved with the app
- OR tips on underwater photography/videography using UWACAM

Note: All posts must tag UWACAM.

If your application is successful, you'll receive 12 months of free access to all UWACAM premium features! Please be aware of what happens next:

To continue your free access, you must re-apply to the program at least 4 weeks before your free year ends.
If you do not wish to continue, you must cancel your subscription via the App Store before the free period ends.
If you do not re-apply or cancel in time, your subscription will automatically renew as a standard paid annual subscription at the regular price.

Please note that Bumbayaya GmbH cannot provide refunds for charges incurred from automatic renewals. It is your responsibility to manage your subscription and re-application.

Program Terms & Conditions

This document outlines the specific terms and conditions ("Program Terms") governing participation in the UWACAM Free Instructor Access Program ("Program") offered by Bumbayaya GmbH, located in Baar, Switzerland ("the Company," "we," "us," "our"). By submitting an application, you ("the Applicant," "Participant," "you") acknowledge and agree that these Program Terms supplement the Company's main General Terms and Conditions (GTC) and our Data Protection Regulation Statement (DPR). Your application and participation in the Program are conditional upon your acceptance of all three documents.

1. Program Status and Sole Discretion

Participation in the Program is a privilege granted at the sole discretion of the Company and not an absolute right. The Company reserves the absolute right to accept or reject any application and to grant or deny the renewal of any participation for any reason whatsoever.

2. Disclaimer of Warranty

As stated in our GTC, the UWACAM app and the Program are provided "AS IS" and "AS AVAILABLE". The Company disclaims all warranties, express or implied, in connection with the Services and your use thereof.

3. Limitation of Liability

In accordance with Section 4 of our GTC, under no circumstances shall Bumbayaya GmbH be liable for any direct, indirect, special, or consequential damages resulting from your use of the Services. This includes, but is not limited to, personal injury, death, property damage, lost profits, or lost data arising from any diving activities.

4. Primacy of Dive Safety 🤿

4.1. Inherent Risk and Personal Responsibility: You acknowledge that scuba diving is an inherently dangerous activity. You are solely responsible for your own safety, that of your buddy, and any divers under your supervision. You must always adhere to your certification agency's safety standards and dive within your personal limits.

4.2. Safe Diving Practices in All Content: All content created and shared under this Program must visibly and unambiguously promote safe diving. Content depicting any of the following is strictly prohibited: Improper gear, Failure to follow procedures, Uncontrolled buoyancy, Task fixation, or Dangerous actions.

5. Content Creation and Ethical Diving Guidelines

5.1. Promote Passive Observation: The guiding principle is to observe marine life without affecting its natural behavior.

5.2. Interaction with Marine Life: 🐠 Content must never depict touching, handling, provoking, or feeding marine life. Responsible use of lighting is required.

5.3. Interaction with the Environment: Maintain neutral buoyancy. Content must not show any form of contact with the seabed, coral reefs, or other sensitive environments. Do not alter the environment for a composition. Secure all gear.

6. Intellectual Property Rights

You retain ownership of the Content you create. By participating, you grant Bumbayaya GmbH a worldwide, non-exclusive, royalty-free, perpetual, and transferable license to use Content that tags UWACAM for our marketing purposes.

7. Data Protection and Privacy 🔒

By applying, you consent to our full Data Protection Regulation Statement (DPR). We collect Application Data, Usage Data, and Public Content Data to administer the Program, provide support, and for marketing. For full details on your rights to access or delete your data, please see the DPR on our website.

8. Feedback and Communication

Should you be unsatisfied, you agree to contact UWACAM support first before posting public reviews.

9. Termination

The Company may terminate your participation at any time for any breach of these Terms, with violations of safety and ethical guidelines being cause for immediate termination.

10. Governing Law and Jurisdiction

These Program Terms shall be governed by the laws of Switzerland. The exclusive place of jurisdiction for all disputes shall be Baar, Switzerland.
